17 Lakh Students Of UP Got Big Relief; Know What Is Madrasa Act, On Which Supreme Court Took Strict Action

New Delhi : For 17 lakh Muslim students of Uttar Pradesh, a big relief news has come from the country’s capital Delhi on Friday. The matter pertains to Uttar Pradesh Madrasa Act 2004. The Supreme Court has overturned the decision of the Uttar Pradesh High Court to repeal the Madrasa Act. Along with putting a stay on this decision, the Supreme Court has also issued a notice to the Yogi Adityanath government of the state.

Let us tell you that in the year 2004, Madrasa Board Act was made in Uttar Pradesh for the education system and management of Madrasas. Under this, a framework was provided for the establishment, recognition, curriculum and administration of Madrasas for the development of formal education system in the entire Uttar Pradesh. Madrasas were recognized by the Board if they met minimum standards and government aid was also provided to recognized madrasas.

There are 19213 madrassas in UP

At present there are 19213 madrassas in the state including 14677 Tathaniya (primary level) and Faukaniya (Junior High School). 4536 Aaliya (High School) is also running. According to the information received from the government system, just a few days ago the state government conducted a survey of madrassas and it was found that most of the madrassas are illegal. No satisfactory answer could be found as to where they get their funding from.

After this, a petition was filed in the High Court at Prayagraj, terming the Madrasa Act as unconstitutional and a violation of secularism. In its decision to repeal the Madrasa Act, the High Court had said that the state government will arrange additional seats as per the need for the students studying in Madrasas and will establish new schools. The state government will decide whether children in the age group of 6 to 14 years should be enrolled in recognized schools.

Anjum Qadri, manager of Madrasa Azizia Ijajutul Uloom, had challenged this decision in the Supreme Court. Now the Supreme Court has stayed the decision of the Uttar Pradesh High Court and issued a notice to the government. The Supreme Court says that the High Court’s decision will affect 17 lakh students and it is not appropriate to direct the students to transfer to another school.
